GRETNA – A Jefferson Parish woman claims she was injured after a fall on recently waxed floors.
Helene Marquez Toney filed a suit June 13 against Ochsner Medical Center-Kenner LLC and Ochsner Health Foundation LLC in the 24th Judicial District Court alleging negligence.
According to the claim, the plaintiff was at the defendant's property in New Orleans when the incident occurred April 17. The suit states that the plaintiff was picking up documents when she slipped and fell in a hallway where the floors had just been waxed. The plaintiff's impact with the floor caused her head to bleed and required CAT scans in the Ochsner Hospital, where she had to undergo two surgeries to drain a hematoma the fall had caused, according to the suit. The plaintiff claims she has been caused to suffer humiliating damages, including baldness from the surgeries, short-term memory loss and inability to function on her own.
The defendants are accused of negligence for failing to warn of the condition, negligence through failing to manage the property in a responsible way and gross negligence in all details of the case.
The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Anthony S. Taormina of the Law Offices of Anthony Taormina.
