Crosby Dredging alleged to have failed to mark pipe, which damaged man's boat

NEW ORLEANS – A Raceland individual and his insurer allege an unmarked dredge spoil pipe caused damages to a boat.

AIG Property Casualty Co. and Jonathan Pinell filed a complaint on June 9 in the U.S. District Court for the Eastern District of Louisiana against Crosby Dredging LLC and Dredge Caroline Frances alleging negligence.

According to the complaint, the plaintiffs allege that on June 11, 2016, Jonathan Pinell suffered damages to its 32-foot contender estimated at $81,699.26 when it struck a submerged dredge pipe.

The plaintiffs holds Crosby Dredging LLC and Dredge Caroline Frances responsible because the defendants allegedly failed to properly mark their dredge spoil pipe's location at the Flotation Canal.

The plaintiffs request a trial by jury and seek an order for the vessel to be condemned and sold to pay plaintiffs' damages, plus interest, costs and all other general and equitable relief. They are represented by Philip S. Brooks Jr., Ronald J. Kitto and R. Ethan Zubic of Gordon, Arata, Montgomery, Barnett, McCollam, Duplantis & Eagan LLC in New Orleans.
