NEW ORLEANS – An underwater diver residing in Texas alleges that his claim for damages relating to the Deepwater Horizon oil spill has not been settled.
James Michael Page filed a complaint on June 23 in the U.S. District Court for the Eastern District of Louisiana against BP Exploration & Production Inc. citing the Oil Pollution Act.
According to the complaint, the plaintiff alleges that he submitted and satisfied the presentment requirements of his claim to the Deepwater Horizon Economic Claim Center but has yet to receive payment.
The plaintiff holds BP Exploration & Production Inc. responsible because the defendant allegedly failed to deny or settle plaintiff's claim within 90 days after the date upon which the claim was presented.
The plaintiff requests a trial by jury and seeks compensatory damages, plus legal interest, litigation costs and costs and all additional general and equitable relief. He is represented by Reginald E. McKamie Sr. of Law Office of Reginald E. McKamie Sr. in Houston.
