Man seeks payment of disability benefits he alleges Liberty Life Assurance Co. wrongfully denied

NEW ORLEANS – A Mississippi man formerly employed by SABIC Innovative Plastics alleges that his claim for disability benefits was wrongfully denied.

Jerry S. Smith filed a complaint on June 21 in the U.S. District Court for the Eastern District of Louisiana against Liberty Life Assurance Co. of Boston alleging that the administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he is disabled and that the defendant wrongfully denied his claim for disability benefits. The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly abused its discretion by failing to consider the disabling, synergistic effect of the plaintiff's medical conditions.

The plaintiff seeks payment for all benefits due to him plus pre- and post-judgment, attorney fees, costs of suit and all other relief as the facts and law may provide. He is represented by James F. Willeford and Reagan L. Toledano of Willeford & Toledano in New Orleans.
