NEW ORLEANS – A Lafourche Parish man alleges that his Raceland employer has failed to pay maintenance and cure benefits for an injury he sustained while working.
Corey M. Luke filed a complaint on June 30 in the U.S. District Court for the Eastern District of Louisiana against Adriatic Marine LLC alleging that the vessel operator violated the General Maritime Law.
According to the complaint, the plaintiff alleges that on April 26, he was a seaman and member of the crew of defendant's vessel the M/V Whitetail and was working when he felt a sharp burning pain shoot down his left leg. He alleges he was later diagnosed with a lumbar disk displacement.
The plaintiff holds Adriatic Marine LLC responsible because the defendant allegedly has refused to pay maintenance and cure benefits and because of that, he cannot afford needed physical therapy and injections.
The plaintiff requests a trial by jury and seeks commencement of his maintenance and cure benefits, payment of all medical expenses, attorney’s fees and all other such damages recognized by law. He is represented by Hunt B. Downer Jr. and David C. Pellegrin Jr. of Waitz & Downer in Houma.
