Weyerhauser alleges mineral producers breached contract

LAFAYETTE — Weyerhauser is suing mineral producers, alleging breach of lease agreement.

Weyerhaeuser Company filed a complaint on July 3, in the U.S. District Court for the Western District of Louisiana against Pardee Minerals LLC, EP Energy, E&P Company LP, Wildhorse Resources II LLC, et al, alleging they failed to fulfill their contractual obligations.

According to the complaint, Weyerhaeuser alleges its suffered damages for not receiving any of the proceeds of the mineral production on its land and for diminution in value of the land in Bienville Parish, Louisiana. 

The plaintiff alleges the defendants failed to use the mineral servitude for more than 10 years after it was created and retained the proceeds that were not due to them.

Weyerhaeuser seeks trial by jury, all unpaid production proceeds, disgorgement of all revenue obtained by the defendants from any mineral production from the plaintiff's land and for all other relief due the plaintiff. It is represented by attorneys Paul LeBlanc, Shelton Dennis Blunt, Jack B. Stanley and Kevin W. Welsh of Phelps Dunbar LLC in Baton Rouge.
