Poeyfarre Street unit owner seeks damages after broken water pipe harmed property

NEW ORLEANS – The owner of a Poeyfarre Street property alleges a broken pipe at a neighboring property caused damages.

Louis Curt Pannagl filed a lawsuit July 26 against American Capital Assurance Corp.; Hamilton Speciality Insurance; Capital Preferred Insurance Co. Inc.; Cunningham and Lindsey US Inc.; The Cotton Mill Condominium Association Inc.; WJMB Transport No. 1 LLC, doing business as Two Men and a Truck; Brian Condon; Tracy Condon and Touffic Eleid in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff owns Unit No. 171 while the Condons own Unit 417. The suit states that on Oct. 12, 2016, Eleid, who was renting the property from the Condons, and WJMB Transport disconnected a washing machine and water from the broken water pipe damaged the plaintiff's property.

The plaintiff was told to pay for the repair and that he would be reimbursed for the repairs by the insurance company, but American Capital Assurance Corp. and Capital Preferred Insurance Co. Inc. denied liability and refused to pay the claim.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Pedro F. Galeas of The Galeas Law Corp. in New Orleans.

The case has been assigned to Division A Judge Tiffany G. Chase.
