Orleans Parish man says A/C, heating system was improperly installed and not repaired

NEW ORLEANS – An Orleans Parish man claims he paid more than $80,000 on an air conditioning and heating system that malfunctioned.

James R. Dugan II filed a lawsuit against Surgi's Heating and Air Conditioning Inc. in Orleans Parish Civil District Court, alleging the work was improperly completed.

According to the complaint, the plaintiff hired the defendant in 2012 to complete an evaluation of this heating and A/C system in his home. The defendant allegedly advised that the plaintiff invest $80,000 in the overhaul of the systems in the building, which the plaintiff did. However, the plaintiff claims that since then, there have been numerous issues, including water and mold damage in 2016.

The defendant is accused of being negligent and breached a contract by failing to do a proper job of the installations and failing to be honest with the plaintiff about the damages.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney David L. Browne of BrowneLaw LLC in New Orleans.

The case has been assigned to Division C Judge Sidney H. Cates IV.
