Grandmother claims she was injured trying to protect grandchild from fall in New Orleans

NEW ORLEANS – A grandmother claims that she was injured trying to protect her grandchild after they tripped and fell.

Patricia B. Peter on behalf of a minor child filed a lawsuit against the city of New Orleans, officially, and Command Construction Industries LLC in Orleans Parish Civil District Court, alleging negligence.

According to the complaint, the defendant had contracted Command to resurface streets in the Carrollton area. The suit states on Aug. 6, 2016, the plaintiff and her grandchild were walking across a surface that was being repaved. The plaintiff claims they tripped and fell on a defective surface and in the fall, the plaintiff was injured trying to protect the child, who suffered minor injuries.

The defendant is accused of negligence by failing to provide adequate warning of the condition of the surface, leaving a dangerous portion of pavement exposed and overall negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by herself.

The case has been assigned to Division F Judge Christopher J. Bruno.
