An individual is seeking damages from Walmart and other entities

NEW ORLEANS — An individual is seeking damages, claiming that Walmart and Burger King were negligent in placing signage to warn him about a wet floor.

Elbert A. Desselle filed a lawsuit on Oct. 6 in Orleans Parish Civil District Court against Brooks Restaurants Inc., Brooks Holdings LLC, Sentinel Insurance Company Ltd. d/b/a The Hartford, Jessica Lee, Burger King Corporation and Walmart Stores, alleging negligence.

According to the complaint, the plaintiff is seeking damages for an incident that allegedly took place on Oct. 8, 2016. The suit claims that the plaintiff was at a Burger King restaurant that was located inside the Walmart Supercenter at 5110 Jefferson Highway in Harahan, La. The plaintiff allegedly encountered a wet and slippery portion of floor that was allegedly not clearly marked, causing him to slip, fall and sustain injuries.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Gregory P. Dileo of the Law Offices of Gregory P. Dileo APLC in New Orleans.

The case has been assigned to Division N Judge Ethel S. Julien.
