A man claims that he was caused to fall from a defective balcony

NEW ORLEANS — A man is seeking damages, claiming that he was caused to fall from a faulty balcony.

Tyler Fowler filed a lawsuit on Oct. 10 in Orleans Parish Civil District Court against Eric Hatten, XYZ Insurance Company, 524 Dauphine Street Condominium Association Inc. and TUV Insurance Company, alleging negligence.

According to the complaint, the plaintiff was at 528 Dauphine St. in New Orleans on Aug. 31. The suit claims that the plaintiff was caused to fall from a balcony, which allegedly had a defective railing.

The defendants are accused of negligence for allegedly failing to warn the plaintiff of the danger or provide a safe premises.

The plaintiff seeks all reasonable damages, court costs, attorney fees and appropriate relief. The plaintiff is represented by attorney Jacob H. Thomas of Beall & Thies LLC in Baton Rouge.

The case has been assigned to Division F Judge Christopher J. Bruno.
