Toilet paper holder allegedly injures customer in Rouses store

NEW ORLEANS – A woman claims that her foot was injured when a commercial toilet paper holder fell on her in a Rouses store.

Catrie Gibbs filed a lawsuit on Nov. 14 against Rouses Enterprises LLC, d/b/a Rouses Markets, and XYZ Insurance Company in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff is seeking damages for an incident that took place on March 7. The plaintiff was in the defendant's bathroom at 4001 General DeGaulle when a large commercial toilet paper holder allegedly fell on her foot, causing injuries and serious pain.

The defendant is accused of negligence through failing to ensure that the holder was properly attached, failing to warn of danger and overall negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Gerald Wasserman in Metairie.

The case has been assigned to Division L Judge Kern A. Reese.
