Man seeks damages from fall in Subway bathroom

NEW ORLEANS – A man is seeking damages, claiming that he was caused to slip and fall in a bathroom at a Subway restaurant.

Arthur Biagas filed a lawsuit Dec. 15 against Doctor's Associates Inc.; OSTA Enterprises LLC, doing business as Subway No. 10908 and No. 4376; and Hartford Casualty Insurance Co. in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff is seeking damages for an incident that took place on March 5, 2017. The suit states that the plaintiff went to the restroom and was caused to trip and fall on the ground.

The defendant is accused of negligence through failing to warn of the danger and failing to clean it.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Anthony S. Taormina of the Law Offices of Anthony Taormina in Metairie.

The case has been assigned to Division J Judge D. Nicole Sheppard.
