Parents claim child was injured by another cheerleader

NEW ORLEANS – Parents claim that their child was injured while cheerleading.

Ronald and Stacey Fassbender, as legal guardian of their child, filed a lawsuit Jan. 10 against Holy Cross School, Bollinger Specialty Group, and Alvin and Sheri Melanson as legal guardian of their minor child in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiffs are seeking damages for an incident that took place Sept. 20, 2017. The suit states the plaintiffs' child was cheerleading at a Holy Cross High School cheer event when the defendants' child kicked the plaintiffs' child in the head. The injured child has suffered neck, back and ear injuries that have required medical treatments.

The defendant is accused of negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiffs are representing themselves.

The case has been assigned to Division C Judge Sidney Cates IV.

The Orleans Parish Civil District Court Case No. is 2018-294.
