State claims couple misused, failed to pay back post-Katrina grant

NEW ORLEANS – The State of Louisiana that a couple failed to follow the rules outlined for a home improvement grant.

State of Louisiana Division of Administration Office of Community Development Disaster Recovery Unit filed a lawsuit Dec. 11 against John Fitzgerald Fleming and Lucy Mayfield Fleming in Orleans Parish Civil District Court alleging breach of contract.

According to the complaint, the plaintiff is seeking damages claiming the defendant was provided with a grant for home improvements following Hurricane Katrina. However, the plaintiff has failed to comply with the necessary process and has not provided the necessary proof of compliance, according to the lawsuit.

The defendant is accused of breach of contract.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Mary Catherine Cali of Shows, Cali & Walsh LLP in Baton Rouge.

The case has been assigned to Division N Judge Ethel Julien.

The Orleans Parish Civil District Court Case No. is 2017-11847.
