Renter sues landlord after mold runs rampant in apartment

NEW ORLEANS – A woman claims that her belongings were damaged by uncontrollable mold in her apartment.

Rachel Kimball and her dog sitter, Tanya Silvernagel, filed a lawsuit on Jan. 25 against Laura Kamenitz, Elliot Kamenitz, NOLA CAT LLC, aka NOLA Cat Properties LLC, Spanish Stables Condo Association, Sunshine Home Inspection LLC, ABC Insurance Company, XYZ Insurance Company in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiffs are seeking damages for an incident that took place at the address of 724 Governor Nicholls St., Apt. G. Kimball was renting the property from the defendants who informed her of water damage in one of the closets; however, she allegedly was told it was safe to store items in the closet.

While Silvernagel was staying in the apartment caring for Kimball's dog, mold allegedly was discovered in the apartment and she was forced to leave. Later, when she and Kimball returned to the apartment, they allegedly discovered that chemicals had been sprayed in the closet and Kimball's property was damaged. The two allegedly spent more than 80 hours dealing with the after affects of the damage.

The defendant is accused of negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Daya Naef in New Orleans.

The case has been assigned to Division A Judge Henry Julien Jr.
