Man claims co-property owner is unwilling to sell

NEW ORLEANS – A man claims that a co-property owner is unwilling to come to a sale agreement.

Alvin D. Mitchell filed a lawsuit Jan. 5 against Birdell T. Mitchell Jr., Terrell B. Mitchell and Yorinell D. Mitchell in Orleans Parish Civil District Court alleging failure to partition.

According to the complaint, the plaintiff is seeking damages claiming that the defendants, co-owner with the defendant for the property at 1016 Independent St., is unwilling to negotiate with the plaintiff for the sale of the ownership of the property.

The defendant is accused of unwillingness to partition.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Charlene Smith of The Smith Firm LLC in Metairie.

The case has been assigned to Division D Judge Nakisha Ervin-Knott.

The Orleans Parish Civil District Court Case No. is 18-137.
