Man claims minority owner refuses to partition land

NEW ORLEANS – A man claims he is the majority owner of a property that the minority owner refuses to partition.

Earl J. Tauzier Jr. filed a lawsuit Jan. 16 against Wilson N. Martin, in his capacity as administrator of the succession of Cynthia Ann Tauzier, wife of Wilson N. Martin, in Orleans Parish Civil District Court alleging failure to partition.

According to the complaint, the plaintiff is seeking damages as the 75 percent owner of the property at 5320 Wickfield Drive. The suit states the defendant, who is only 25 percent owner of the property is unwilling to partition the property.

The defendant is accused of unwillingness to partition the property.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Steven Oliver of Gaudry, Ranson, Higgins & Gremillion LLC in Gretna.

The case has been assigned to Division C Judge Sidney Cates IV.

The Orleans Parish Civil District Court Case No. is  2018-475.
