Medical malpractice 08

GRETNA – Two sons claim that their mother died due to negligence and breach of care by a pharmacy.

Gerard J. Gautreau and John R. Gautreau, individually and on behalf of their deceased mother Judith S. Ibarz, filed a suit on Jan. 26 against Chateau Pharmacy, doing business as Chateau Drugs & Gifts, and ABC Insurance Company in the 24th Judicial District Court alleging negligence and breach in the standard of care.

According to the claim, the plaintiffs are seeking damages for an incident that took place in January 2017. The suit states that the plaintiffs' mother was seeing numerous physicians and was receiving numerous prescriptions from the defendant. The pharmacy allegedly did not check to see if the drugs prescribed were excessive or dangerous to Ibarz, who passed away on Jan. 18, 2017. The suit states that the defendant was negligent in the standard of care and is to blame for Ibarz's death.

The defendant is accused of negligence and breach in the standard of care.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by J. Michael Daly Jr. in Metairie.

The case has been assigned to Division H Judge Glenn B. Ansardi.
