Fresenius Medical Care allegedly damaged property

GRETNA — All State Financial Company claims that a tenant abused its property.

All State Financial Company filed a suit on Feb. 15 against NNA of Louisiana LLC, dba Fresenius Medical Care Ochsner-West Bank, aka Fresenius Medical Care Westbank and National Nephrology Associates Inc., in the 24th Judicial District Court alleging breach of contract.

According to the claim, the plaintiff claims that it entered into a commercial lease agreement with the defendant in March 2004. The suit states that the defendant was extremely abusive of the property and failed to make the repairs that they were responsible for, leaving the plaintiff with a great deal of expense and work to complete.

The defendant is accused of negligence and breach of contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Warren Horn of Heller, Draper, Patrick, Horn & Manthey LLC in New Orleans

The case has been assigned to Division E Judge John J. Molaison Jr.
