Jefferson Parish crew is accused of damaging family's trees

GRETNA – A family is seeking damages after their tree was damaged by a work crew.

Margaret M. Babin and Wilbur J. Babin Jr. filed a complaint on Sept. 11 in the 24th Judicial District Court against The Parish of Jefferson, Fleming Construction Co. LLC and Atmos Energy.

According to the complaint, the plaintiff is seeking damages for an incident that took place on Sept. 20, 2017 when the plaintiff's two live oak trees at 337 Rosa Ave. in Metairie were damaged due to the defendant's negligence in using a backhoe and destroying their root systems.

The defendant is accused of negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Wilbur Babin Jr. of The Derbes Law Firm LLC in Metairie.

The case has been assigned to Division L Judge Donald Rowan Jr.

The 24th Judicial District Court Case No. is 787438.
