Man claims a metal item fell on him at a Walmart store

NEW ORLEANS – A man is seeking damages for an injury he sustained at a Walmart.

Lionel Donaldson filed a complaint on Dec. 17 in Orleans Parish Civil District Court against Walmart Inc. and Wal-Mart Louisiana LLC.

According to the complaint, the plaintiff is seeking damages for an incident that took place on Dec. 19, 2017 when the plaintiff was at the Walmart at 1901 Tchoupitoulas St. The suit states the plaintiff was injured when a heavy item fell from a shelf above and struck the plaintiff. 

The defendant is accused of negligence and failing to take the appropriate precautions to prevent injury.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Michael Brandner of Mike Brandner Injury Attorneys in Metairie.

The case has been assigned to Division B Judge Rachael Johnson.

The Orleans Parish Civil District Court Case No. is 2018-12615.
