Briar Meads Capital Trust seeks more than $40 million in sums due

GRETNA – A trust is seeking more than $40 million in sums due, alleging a customer was negligent in the balance owed.

Briar Meads Capital Trust Series 2 filed a complaint on Dec. 18 in the 24th Judicial District Court against LVP 520 Elmwood Park LLC.

According to the complaint, the plaintiff is seeking damages for sums due on an unpaid balance. The suit states the defendant has remained negligent in the balance owed. The plaintiff is seeking payment for more than $40.6 million plus interest of 9.83 percent per year until the balance is paid in full.

The defendant is accused of sums due on an unpaid balance.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Paul Rotolo of Chaffe McCall LLP in New Orleans.

The case has been assigned to Division J Judge Stephen Grefer.
