Patient claims Ochsner Medical Center breached standards of care

GRETNA – A patient alleges she was caused injury following a medical procedure.

Neydin Zelaya filed a complaint on Dec. 26 in the 24th Judicial District Court against Ochsner Medical Center, Westbank LLC and Jonathan McCall Jr.

According to the complaint, the plaintiff is seeking damages for negligence and breach in the standard of care, alleging the defendant failed to give the plaintiff appropriate treatment. The suit states that on Sept. 8, 2014, the plaintiff was admitted to the defendant's facilities and that she was given lumbar puncture for the pain she was experiencing. The suit also states the plaintiff was caused a great deal of suffering as a result of the lumbar puncture, which she had not experienced prior.

The defendant is accused of negligence and breach in the standard of care.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Cesar Burgos of Burgos & Associates LLC in New Orleans.

The case has been assigned to Division P Judge Lee Faulkner Jr.
