Woman claims she was caused to trip and fall while exiting a Wendy's

NEW ORLEANS – A woman is seeking damages, alleging that she was caused to slip and fall at a Wendy's.

Lashai Westley filed a complaint on Jan. 9 in the Orleans Parish Civil District Court against Haza Foods of Louisiana LLC, dba Wendy's Old Fashioned Hamburgers.

According to the complaint, the plaintiff is seeking damages for an incident that took place on Jan. 16, 2018 when the plaintiff was at the Wendy's at 5701 Read Blvd. The suit states the defendant was walking out of the restaurant and had her foot caught in an uncovered hole in the concrete. The plaintiff claims she was caused to be injured due to the alleged negligence of the defendant through failing to cover the hole.

The defendant is accused of negligence and failure to warn of a dangerous situation. 

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorneys Harold Ehrenberg in Metairie.

The case has been assigned to Division I Judge Piper Griffin.

The Orleans Parish Civil District Court Case No. is 2019-286.
