Kmart shopper alleges she slipped on vomit in restroom, fell and was injured

GRETNA – A Jefferson Parish woman alleges she slipped on a substance believed to be vomit in a Metairie store's restroom and is seeking damages for injuries sustained in the fall.

Shellond Harvey filed a complaint on March 1 in the 24th Judicial District Court against Kmart Stores, also known as Sears Holding Corp., and XYZ insurance.

According to the complaint, the plaintiff was shopping March 1, 2018, at the Kmart in Metairie and was caused to slip and fall on a substance believed to be vomit in the restroom. She alleges no warning signs were posted.

The plaintiff alleges the defendant failed to maintain the floors and failed to inspect and warn of the condition.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Jahada L. Lewis-Crawford in Kenner.

The case has been assigned to Division D Judge Scott U. Schlegel.
