Plaintiff files lawsuit seeking to collect over $100,000 from previous judgment

GRETNA – A man alleges he was not paid for a judgment he received against a construction company.

James Clinton filed a complaint on March 11 in the 24th Judicial District Court against Justin Asper and Asper Construction and Development Group LLC.

According to the complaint, the plaintiff is seeking damages for an incident that took place when the defendant allegedly breached a contract after they failed to successfully install a kodiak steel framing, siding and roof package to the plaintiff's home. The plaintiff obtained a judgment against the defendant for $100,427.95. The defendant, however, has filed for bankruptcy but gone on to open other businesses, allegedly in the hopes of escaping the judgment the plaintiff obtained.

The defendant is accused of breach of contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Kyle Schlafani in New Orleans.

The case has been assigned to Division G Judge E. Adrian Adams.

The 24th Judicial District Court Case No. is 792933.
