NEW ORLEANS — Girod Loanco LLC has been granted its requested motion by the United States District Court for the Eastern District of Louisiana to remand its case to state court.
The plaintiff filed a petition for foreclosure by executor process against Regina B. Heisler on March 12. The plaintiff is seeking to have a property seized and sold in satisfaction of multiple promissory notes given by the defendant in her capacity.
The defendant removed the action to federal court on March 14, alleging complete diversity of citizenship in an amount of more than $75,000. The defendant alleges the plaintiff is a citizen of Delaware and the amount in controversy is more than $4.5 million.
The plaintiff filed a motion to remand on April 12, to which the defendant has failed to file an appropriate opposition to.
The court has ruled that the plaintiff’s motion to remand be granted as the plaintiff and defendant are both citizens of Louisiana.
