Deckhand sues after boats collide on charter fishing trip

BATON ROUGE -- Timothy Carver filed a federal lawsuit on July 14 in the U.S. District Court for Middle District of Louisiana against Captain Morgan Charters, LLC., and Standard Boar Services, LLC for personal injury. 

According to the complaint, on February 25, 2021, David S. Morgan, the sole member and owner of Captain Morgan Charters was piloting the 28’ Fountain fishing vessel on the navigable waters of the Mississippi River in Plaquemines Parish heading away from Venice, Louisiana toward the Gulf of Mexico, and was engaged in commercial charter fishing operations. 

Carver was employed on the boat as a deckhand. Carver alleges to have been severely injured in the course of his employment as a deckhand after two vessels were passing each other, they violently collided with one another, causing Carver to be thrown and sustain injuries to his head, neck, lower back and other parts of his body.

Carver seeks compensation for present and future physical pain, suffering and loss of function; mental pain, anguish and suffering; medical expenses both past, present and future, compensation for permanent disability, scarring and disfigurement; past, present and future loss of enjoyment of life; cost of court and pre and post judgement interest plus attorney's fees. Carver is represented by A. Spencer Gulden of Morris Bart LLC.
