NEW ORLEANS - A former employee has filed a class action lawsuit against Grass Gator Law Care, alleging that the company failed to pay required overtime despite employees working more than 60 hours per week.
Defendant Philip J. Roberson Jr. filed a class-action lawsuit in the U.S. District Court for the Eastern District of Louisiana against Grass Gator Law Care Company alleging violations of the Fair Labor Standards Act and the Portal-to-Portal Act.
According to the lawsuit, the plaintiff is a former employee of Grass Gator Lawn Care Company. Roberson claims that as an employee, he was paid daily and that the defendant routinely failed to pay him and other employees the required overtime premiums despite working significantly more than 60 hours per week.
Robertson is demanding a trial jury to seek damages for back wages, liquidated damages, legal fees, costs, and post-judgment interest, plus court costs, attorneys fees and any other relief the court deems proper. Additionally he is requesting that the case be certified as an FLSA collective action, which would require that notice be issued to all putative collective action members.
