NEW ORLEANS — A Harvey Gulf seaman alleges unsecured stair grating caused his fall and serious injuries.
Elvis Lopez filed a complaint October 18 in federal court against Harvey Gulf International Marine alleging Jones Act negligence.
According to his complaint, Lopez worked for Harvey Gulf as a seaman and was a member of crew of the Harvey Intervention. He claims that on August 2, 2023, he was working on the deck to do off-loading while the vessel was in the navigable waters of Fouchon, Louisiana. Lopez alleges he tripped on the stairs grating which was unstable and not braced or secured. He further claims he suffered a torn medial meniscus on his right knee which required surgery.
Lopez also claims the Harvey Gulf doctor failed to obtain an MRI despite his complaining of neck and back pain and gave him a prescription and allowed him to return to work. He alleges that crew members made several attempts but failed to secure the stair grating.
Lopez seeks monetary relief, interest, trial by jury and other relief.
