Couple sues Ford over allegedly defective pickup

A Vermilion Parish couple has sued Ford Motor Company in federal court over an allegedly defective pickup truck.

Duston Daniel Menard and Amber Rourk Menard purchased a 2021 Ford F-150 from a dealership in Pasadena, Texas, according to the lawsuit. The purchase price was $58,913.52, the suit said.

"Plaintiffs presented the vehicle for repair on at least five occasions and the vehicle was out of service for an excess of 70 days," the lawsuit states. "The vehicle suffered from engine defects that prevented the Plaintiffs from being able to properly use the vehicle."

The defects  are "unreasonably dangerous because it can cause the vehicle to severely malfunction while the vehicle is in operation at any time, thereby

exposing the Vehicle’s driver, passengers, and others who share the road with them to serious risk of accidents and injury or death," the suit states.

It cites the federal Magnuson-Moss Warranty Act.

"This Court has federal question jurisdiction over this matter pursuant to the Magnuson-Moss Warranty Act, in that the Plaintiffs claims more than

$50,000.00 in damages, exclusive of interest and cost," the lawsuit states.

It seeks a refund of the full purchase price or a reduction in the purchase prices plus attorney fees.
The plaintiffs are represented by Kevin Duck of the Duck Law Firm, LLC.
