Military Road Revitalization Company sues St. Tammany Parish Government for the right to challenge a moratorium ordinance

The lawsuit between Military Road Revitalization Company, LLC and St. Tammany Parish Government was filed in the Court of Appeal, First Circuit, Louisiana under the case ID No. 2023 CW 1221 on March 15, 2024. The case revolves around a dispute over the plaintiff's right to challenge a moratorium ordinance imposed by the defendant. The judgment of the district court on November 8, 2023, which partially granted the defendant's exception of no right of action, has been reversed by Judges Welch, Wolfe, and Stromberg.

The plaintiff is represented by their own legal team while the defendant is represented by St. Tammany Parish Government's legal department. The district court had previously ruled that Military Road Revitalization Company did not have the right to challenge a moratorium ordinance enacted by St. Tammany Parish Government. However, this decision was overturned as it was found that the plaintiff indeed had a "real and actual personal stake" in challenging this ordinance.

The Court of Appeal ordered that part of the district court’s judgment denying preliminary injunction be remanded back to the district court with instructions to grant an appeal to Military Road Revitalization Company. The company has been given fifteen days from the date of this order to submit an appeal order.
