Jane Doe sues Raynando L. Banks for alleged discriminatory treatment and intentional infliction of emotional distress

In the case of Jane Doe versus Raynando L. Banks, M.D., Raynando L. Banks, A Medical Corporation, and Louisiana Medical Mutual Insurance Co., filed in the First Circuit Court of Appeal in Louisiana under the court case ID 2023 CA 0914, the plaintiff Jane Doe alleges discriminatory treatment and intentional infliction of emotional distress by Dr. Banks due to her HIV status. The judgment was rendered on March 13, 2024.

Jane Doe, represented by Kennedy A. LeJeune and Todd A. Hebert, claimed that Dr. Banks refused to provide adequate medical treatment due to her HIV status and accused her of being an intravenous drug user. She further alleged that Dr. Banks failed to issue a prior authorization for her prescribed medications despite multiple requests from her and her pharmacy, causing distress and resulting in missed workdays.

Percle who filed a dilatory exception of prematurity on behalf of their clients asserting that Doe's claims arise out of medical malpractice and must first be presented to a medical review panel as per the Louisiana Medical Malpractice Act (LMMA).

Jane Doe is seeking damages for the harm caused by Dr. Banks' alleged discrimination and intentional infliction of emotional distress.
