Margarita H. Simmons sues Teva Pharmaceuticals USA for alleged negligence related to Paragard IUD

Margarita H. Simmons has filed a lawsuit against Teva Pharmaceuticals USA, Inc., Teva Woman’s Health, LLC, Teva Branded Pharmaceuticals Products R&D, Inc., The Cooper Companies, Inc., and CooperSurgical, Inc. in the United States District Court for the Eastern District of Louisiana. The case ID is 2:24-cv-00823-SM-DPC and it was filed on April 2nd, 2024.

Simmons is represented by her counsel of record and claims that all defendants were engaged in the business of developing, designing, testing, manufacturing, labeling, packaging, marketing, distributing and selling the Paragard intrauterine drug/device (Paragon IUD). In late 2013, Dr. Howard Russell prescribed and inserted a Paragon IUD into Simmons who experienced significant pain and bloating during her menstrual periods.

The lawsuit alleges that Simmons did experience relief with her menstrual period due to the device but when Dr. Howard Russell performed a procedure to remove the Paragon IUD from Simmons on April 12th, 2023 complications arose. The amount in controversy exceeds $75,000.

Simmons seeks judgment against all defendants for damages resulting from their alleged negligence related to the Paragard intrauterine drug/device (Paragon IUD).
