State of Louisiana sues Jessie James Baker for illegal carrying of weapons and possession of a firearm by a convicted felon

In the First Circuit Court of Appeal in Louisiana, a case was filed under the ID 2023 KA 0815 on April 19, 2024. The State of Louisiana is the plaintiff against the defendant, Jessie James Baker.

The lawsuit revolves around charges against Baker for illegal carrying of weapons and possession of a firearm by a convicted felon. These offenses were allegedly committed on January 16, 2015. The prosecution team includes District Attorney Scott M. Perrilloux and Assistant District Attorneys Le’ Anne H. Malnar and Brett Sommer. Ravi G. Shah represents Baker.

Baker was found guilty on both counts after a jury trial and was sentenced to ten years imprisonment on Count I and twenty years on Count II, without benefits of parole, probation or suspension of sentence. After being adjudged as a second-felony offender based on a previous conviction, his sentences were vacated and he was resentenced to forty years imprisonment for each count.

The plaintiff seeks to uphold the court's decision while Baker appeals against it arguing that his sentences are unconstitutionally excessive.
