State of Louisiana sues Jaleel Green for possession of a firearm by a convicted felon

The State of Louisiana has filed a lawsuit against Jaleel Green in the Court of Appeal, Fourth Circuit, under case ID 2024-K-0169. The case revolves around the suppression of evidence seized during a search on Green, with the state dissenting the district court's ruling. The case was initiated on October 17, 2023.

The State charged Green with possession of a firearm by a convicted felon, illegal carrying of a weapon while in possession of a controlled dangerous substance, and possession of a weapon with an obliterated serial number. The charges were based on an incident that occurred on August 15, 2023, where Officer Patrick McFarlane responded to a call at 837 Gravier Street.

Green filed various motions including one for suppression of statements and evidence which led to a hearing on January 17, 2024. Post-hearing, the court issued a written ruling granting the motion to suppress and finding no probable cause on February 23, 2024. The State then expressed its intent to seek writs and set March 23 as the return date.

The plaintiff is seeking reversal of the district court's ruling suppressing the evidence. They argue that police officers seized Green's concealed weapon based on reasonable suspicion and that derivative evidence recovered was incident to lawful arrest. Therefore, they contend that the district court erred when it suppressed this evidence and found no probable cause.
