TKTMJ sues The Sewerage & Water Board of New Orleans for breach of contract

In the case of TKTMJ, Inc. versus The Sewerage & Water Board of New Orleans, filed in the Court of Appeal Fourth Circuit, State of Louisiana under case ID 2023-CA-0787, TKTMJ appeals a trial court's judgment denying its motion for post-judgment relief. The case was affirmed on April 25, 2024. Scott Hedlund represented TKTMJ while John M. Landis and Nicholas J. Wehlen from Stone Pigman Walther Wittmann L.L.C. defended the Sewerage & Water Board.

The lawsuit originates from a breach of contract involving two contracts for the replacement of two sewerage pumping stations between TKTMJ and the Sewerage & Water Board. The trial court initially awarded TKTMJ $1,719,808.24 in damages but this was later reduced to $1,555,064.03 on appeal.

TKTMJ sought an order to prevent any interruption in service by the Sewerage & Water Board due to failure to timely pay an invoice for water and sewer service which they argued was extinguished by operation of law through compensation. This motion was denied by the trial court on August 31, 2023.
