Woman files lawsuit against USAA General Indemnity Company over alleged contract breach

Chasity Blanchard has filed a lawsuit against USAA General Indemnity Company in the Acadia Parish District Court, Louisiana and later brought to the U.S. District Court - Western District of Louisiana. The case ID is C-202410267 and was filed on May 10, 2024. The nature of the action is a contract dispute.

The lawsuit was served to USAA General Indemnity Company through its registered agent, the Louisiana Secretary of State, on April 18, 2024. The legal representation for Blanchard is Lee Hoffoss Injury Lawyers, LLC.

The plaintiff alleges that due to high winds a tree on her property in Acadia Parish, LA had fallen and damaged the plaintiffs property.  Initially the plaintiff took steps to mitigate the damages to her home at her own expense. 

On September 9th, 2023 an inspector acting on behalf of USAA inspected the property and damages.  On September 21st, 2023 a license engineer acting on behalf of USAA also inspected and documented damages. These inspections of the property constituted satisfactory proof of loss but did not accurately account for all damages to the property accordingly and could not fix all damages from the initial settlement provided by USAA. 

On November 5th, 2023 the plaintiff hired a licensed public adjuster to inspect her property at her own expense.  On November 28th, 2023 she also hired a licensed engineer to inspect her property.  They revealed significantly more damages which resulted in a much higher estimate.

Despite providing proof of loss USAA has chosen to underpay the plaintiff and are therefore in violation of their contract. 

Blanchard seeks judgment against USAA General Indemnity Company for alleged breach of contract. She also demands compliance with her petition or an appearance by the defendant either by filing an answer or other pleading within the delay provided in Article 1001 of the Louisiana Code of Civil Procedure under penalty of default.
