Patient Alleges Negligence Against Medical Device Companies Over Defective Implant

A recent court filing in the Eastern District of Louisiana has brought to light serious allegations against two medical device companies. The complaint, filed by Eboni Honore on September 12, 2024, targets AngioDynamics, Inc. and Navilyst Medical, Inc., accusing them of negligence and other significant breaches related to a defective medical device.

Eboni Honore, a resident of New Orleans, Louisiana, has initiated this lawsuit after experiencing severe complications from an implantable vascular access device known as Vortex LP. According to the complaint, Honore was implanted with the Vortex LP for transfusions related to her Sickle Cell Anemia. However, she claims that the device was defective and led to serious injuries due to its faulty design and manufacturing process. The complaint outlines multiple counts against AngioDynamics and Navilyst Medical including negligence, design defect, failure to warn, breach of implied warranty, breach of express warranty, fraudulent concealment, and violations under the Louisiana Product Liability Act (LPLA).

The lawsuit details how the Vortex LP device is intended for repeated access to the vascular system for delivering medications and other fluids. However, it alleges that the device's catheter component contains a high concentration of barium sulfate particles which degrade over time causing mechanical failures such as microfractures. These defects purportedly lead to infections and other severe complications. Honore's legal team asserts that both defendants were aware or should have been aware of these risks but failed to adequately warn patients or their healthcare providers.

In addition to negligence in design and manufacturing processes, the complaint accuses AngioDynamics and Navilyst Medical of concealing adverse event reports from regulatory bodies like the FDA through controversial programs like Alternative Summary Reporting (ASR). This concealment allegedly prevented healthcare providers from being fully informed about the risks associated with using Vortex LP devices.

Honore is seeking comprehensive relief from the court including general damages for pain and suffering as well as compensation for past present future medical expenses related to her injuries caused by the defective device. She also demands costs attorney’s fees under LPLA along with pre-judgment post-judgment interest.
