A Louisiana man has filed a lawsuit against a local restaurant, alleging violations of the Americans with Disabilities Act (ADA) and the Louisiana Commission on Human Rights (LCHR). The complaint was filed by Jason Lenz in the United States District Court for the Eastern District of Louisiana on September 16, 2024, targeting Pine Street Moguls LLC.
According to the court documents, Jason Lenz is an amputee who uses a wheelchair for mobility. He claims that he encountered significant barriers when attempting to access the restaurant located at 116 West Pine Street in Ponchatoula, Louisiana. Specifically, Lenz states that there is an impermissible change in level at the entrance of the property which prevents wheelchair access. Additionally, he mentions that there are three steps leading up to the restroom within the establishment, further hindering his ability to use the facilities.
Lenz asserts that these barriers violate Title III of the ADA and provisions under the LCHR. "During my visit in Summer 2024, I could not enter the Property because there is an impermissible change in level at the entry," Lenz stated in his complaint. He continues to desire visiting this restaurant but fears encountering these same obstacles again. The plaintiff believes that removing these barriers is readily achievable and would not impose an undue burden on Pine Street Moguls LLC.
The lawsuit seeks declaratory and injunctive relief to compel Pine Street Moguls LLC to make necessary alterations to ensure accessibility for individuals with disabilities. Furthermore, Lenz demands compensatory damages for injuries and losses sustained due to what he describes as discriminatory conduct by the defendant. He also requests reasonable attorneys' fees and costs associated with bringing forth this action.
