Daniel Todd, a Louisiana resident with a disability, has filed a lawsuit against CMJ Enterprises, LLC and Randal Alexandria 12845 Corporation for alleged violations of the Americans with Disabilities Act (ADA) and the Louisiana Commission on Human Rights (LCHR). The complaint was filed in the United States District Court for the Western District of Louisiana on October 31, 2024. Todd claims that both defendants have failed to provide accessible facilities at their Subway restaurant located at 719 MacArthur Drive in Alexandria, Louisiana.
According to the complaint, Daniel Todd is missing a leg and requires a wheelchair for mobility. He resides in Winn Parish, Louisiana, and frequently visits Alexandria for medical treatment. During his visits to the Subway restaurant owned by CMJ Enterprises and operated by Randal Alexandria Corporation, Todd encountered several architectural barriers that hindered his access. These included the absence of designated accessible parking spaces and a damaged curb ramp connecting the parking lot to the facility's promenade. Furthermore, Todd alleges intentional discrimination by an employee of Randal Alexandria who refused service due to his disability.
Todd's legal team argues that these barriers violate Title III of the ADA and LCHR regulations. They assert that removing these obstacles is "readily achievable" and would not impose an undue burden on the defendants. The lawsuit seeks declaratory and injunctive relief to compel compliance with accessibility standards, as well as compensatory damages for Todd's emotional distress and humiliation resulting from discriminatory treatment.
The plaintiff is represented by attorneys Andrew D. Bizer, Garret S. Dereus, and Eva M. Kalikoff from Bizer & DeReus LLC based in New Orleans. The case is identified under Case No.: 1:24-cv-01499 but does not list specific judges assigned yet.
