Plaintiff Widow Alleges Pool Company Negligence Led to Husband's Death

Guillermina Castaneda has filed a lawsuit against a pool company, accusing it of negligence that led to the tragic death of her husband. The complaint was filed in the Federal District Court for the Eastern District of Louisiana on January 9, 2025, naming Gulf South Design Group, Inc., doing business as Sunkissed Pools, as the defendant.

The case centers around a devastating incident that occurred on May 4, 2024. Narciso Hernandez Fragoso, an employee tasked with replacing a roof in poor condition, suffered a fatal fall due to what Castaneda claims was gross negligence by his employer. According to the complaint, Sunkissed Pools failed to provide a safe working environment and even went so far as to instruct other employees to hide and abandon Mr. Fragoso after his fall. Guillermina Castaneda is seeking justice not only for herself but also on behalf of her late husband's estate.

The lawsuit accuses Sunkissed Pools of several legal violations, including negligence and wrongful death. It alleges that the company neglected its duty to identify and mitigate workplace hazards and failed to ensure proper safety measures were in place. Furthermore, the suit claims that Sunkissed Pools did not adequately screen or train its project supervisors, leading directly to Mr. Fragoso's untimely death. The plaintiff argues that these failures constitute gross negligence, as they demonstrated a reckless disregard for safety.

Castaneda is pursuing compensation for various damages resulting from this incident. These include wrongful death and survivorship damages, economic losses such as lost wages and earning capacity, mental anguish, pain and suffering, medical expenses, loss of consortium and inheritance, costs associated with the lawsuit itself, exemplary damages meant to punish egregious conduct by the defendant, and any other applicable relief deemed just by the court.
