Plaintiff Alleges Local Restaurant Violated Disability Access Laws

Daniel Todd, a Louisiana resident with a disability, has filed a lawsuit against two companies for alleged violations of the Americans with Disabilities Act (ADA) and the Louisiana Commission on Human Rights (LCHR). The complaint was filed in the United States District Court for the Western District of Louisiana on January 13, 2025, naming Alexandria Pizza Hut LLC and ADT Louisiana LLC as defendants.

The lawsuit stems from Todd's experience at a Pizza Hut located at 3927 S MacArthur Drive in Alexandria, Louisiana. Todd claims that architectural barriers at the restaurant deterred him from entering and accessing its services. According to the complaint, these barriers include changes in level within designated-accessible parking spaces and aisles, lack of vertical signage for accessible parking spaces, and other unspecified mobility-related obstacles. Todd argues that these conditions violate both federal and state laws designed to protect individuals with disabilities.

Todd's complaint outlines his personal challenges due to his disability—he is missing a leg and requires a wheelchair for mobility. Despite living nearby in Winnfield, Louisiana, Todd frequently visits Alexandria for medical treatment and other amenities not available in his hometown. He asserts that he plans to return to the Pizza Hut location but fears encountering the same accessibility issues unless they are remedied.

The plaintiff accuses Alexandria Pizza Hut LLC and ADT Louisiana LLC of failing to comply with ADA requirements and discriminating against him based on his disability. He alleges that removing these barriers is "readily achievable" without imposing an undue burden on the defendants. Furthermore, Todd seeks compensatory damages under LCHR provisions for what he describes as discriminatory conduct by the defendants.

In addition to monetary compensation, Todd requests injunctive relief compelling the defendants to modify their property to ensure full accessibility for individuals with mobility disabilities. He also seeks declaratory relief affirming that the property violates ADA and LCHR standards. Moreover, Todd demands reimbursement for attorneys' fees, costs associated with expert witnesses, and other litigation expenses.
