Couple sued by New Orleans Redevelopment Authority for not properly developing land

NEW ORLEANS – The New Orleans Redevelopment Authority is suing a couple and the City of New Orleans in attempt to reclaim a piece of property.

New Orleans Redevelopment Authority filed suit against Bonnie Irving, Bruce Anthony Derbigny and the City of New Orleans on April 14 in the Orleans Parish Civil District Court.

New Orleans Redevelopment Authority claims that on Aug. 26, 2011 the defendants acquired a piece of property in New Orleans from the Road Home Corporation, but that New Orleans Redevelopment Authority intervened in the sale to enforce obligations imposed on and accepted by the defendants.

The plaintiff contends the sale provides for an agreement to maintain property and an agreement to repair or develop the property. However, New Orleans Redevelopment Authority asserts that more than a year has passed since the defendants purchased the property and the defendants have failed and refused to maintain the property or to achieve progress towards the structure. The plaintiff further contends it is entitled to invoke and avail of contractual remedies to divest the defendants of their ownership interest in the subject property and transfer its title to New Orleans Redevelopment Authority. In addition, the plaintiff claims all sums paid by the defendants for the property and any and all improvements made to the property by these defendants should be forfeited.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for attorney fees and general and equitable relief.

The plaintiff is represented by attorney Christopher Gaubert.

The case has been assigned to Division G Judge Robin M. Giarrusso.
