Local business sues property insurer for failing to cover hailstorm damage

GRETNA – A local business is suing its property insurer for allegedly not properly adjusting and paying a claim after its building and contents were damaged in a hailstorm.

Exactly Legends LLC filed suit against Essex Insurance Company in the 24th Judicial District Court on April 22.

Exactly Legends contends it owns property located at 2708 N. Hullen St. in Metairie that was covered by a property insurance contract provided by Essex Insurance Company. The plaintiff asserts that its property and much of its contents were damaged when a hailstorm struck the area on April 24, 2013. Exactly Legends says it made a claim with Essex Insurance Company in a timely manner. The plaintiff alleges the defendant inspected the property, but have failed to offer a payment.

The defendant is accused of breach of contract, bad faith and violation of state law.

An unspecified amount in damages is sought for loss of insured property, loss of enjoyment, loss of business income, loss of movable goods, diminution in property value, remediation expenses, temporary repair expenses, attorney’s fees and costs of litigation.

The case has been assigned to Division I Judge Nancy A. Miller.
