Radio Shack sues landlord claiming flooding destroys over $700K of electronics

NEW ORLEANS – Radio Shack is suing the owners of the building where they previously had a store saying they are at fault for more than $700,000 worth of damages from a flood.

Radioshack Corporation filed suit against Canal Royal, LLC, Astor Crowne Plaze, LLC, and Starwood Capital Group Global, L.P., in the Orleans Parish Civil District Court on May 8, 2015.

The plaintiff claims that the defendant owned and operated the building in which its store was located. It claims that the original lease was signed on Feb. 22, 1996 and had been extended through 2016. According to the plaintiff, the leased premises flooded because the drainage system for the building became clogged, forcing the store to close, extensive repairs and substantial damages both to inventory and sales.

The defendants are accused of neglecting their duty under the lease and civil code to keep the premises in good condition and suitable for the use for which they were leased. The plaintiff is suing for damages as a result of the loss of sales as well as the cost of closing and repairing the store, the loss of merchandise and profits, the rent for the period of time the store was closed, reasonable attorneys fees and for legal interest.

The plaintiff is represented by New Orleans-based attorneys Sidney L. Shushan and Jonathan M. Shushan.

This case has been assigned to Div. J Judge Paula A. Brown.
