An accident that occurred in May 2009 near South Claiborne Avenue and Martin Luther King Boulevard in New Orleans resulted in severe and disabling injuries to Malkia Collins, a passenger in the car.
Collins has petitioned the Civil District Court for the Parish of Orleans for damages from injuries she suffered.
According to the complaint, Collins was riding in a vehicle owned and operated by Darrell Gibson when a vehicle owned and operated by Allyson Cabes struck them. Cabes allegedly failed to see what he should have seen, failed to keep a good and careful lookout, failed to maintain reasonable and proper control of the vehicle, was speeding, operated the vehicle in a careless and reckless manner and followed too closely.
Collins is suing Cabes and her insurer, Geico Indemnity Co., as well as Gibson's insurer, 21st Century Insurance Co.
She claims past physical pain and suffering, future physical pain and suffering, past mental pain and suffering, future mental pain and suffering, rental expenses, property damage, loss of use and or depreciation of vehicle, past and future medical expenses, loss of past and future earnings, loss of future earnings capacity, permanent disability of the body, loss of consortium, loss of enjoyment of life, penalties and attorney's fees.
