Woman sues over parking lot trip and fall

A woman who tripped on steel metal plates that were being used to cover holes and repair work at a gas station on West Thomas Street in Tangipahoa Parish last year, is suing over her injuriees.

Ola King claims she had to be transported to the hospital after the incident occurred on Marcy 26, 2009.

She is suing Wal-Mart Louisiana, Wal-Mart Stores, Murphy Oil USA, Liberty Mutual Insurance Co., Harco Services, and Mid-Continent Services Casualty Co., over the incident which took place at a Murphy Oil gas station located on the premises of a Wal-Mart store.

The case was filed March 31 in Tangipahoa District Court, but defendants removed the case to the New Orleans federal court on May 6.

Defendant Harco Services was a construction company contracted by Murphy Oil to perform repair and renovations. King alleges Harco placed the metal sheets on the ground.

Shortly after her fall, King states the gas station placed safety cones around the metal plates to warn other patrons of the dangerous condition.

King argues the defendants are negligent for failing to take all precautions to avoid this incident, failing to remove a dangerous material from the walkways of the premises, failing to warn its customers of the dangerous condition, failing to re-route traffic away from the dangerous conditions and failing to secure the dangerous material to the premises.

She is seeking damages for personal injuries, medical expenses, loss of wages and future earnings, pain and mental anguish, interest and court costs.
