Car owner says Toyota to blame for crash into store

Two New Orleans residents have filed suit against Toyota, saying a stuck accelerator caused them to crash into a store.

Claudia H. Taylor and Shenita Walker filed suit against Toyota Motor North America, Toyota Motor Engineering & Manufacturing North America and Toyota Motor Sales, U.S. A. June 3 in federal court in New Orleans. The two women were inside a Toyota Camry that crashed into the back of a Dollar General Store in New Orleans June 13, 2008.

Taylor says she was driving her 2006 Camry into the parking lot of the Dollar General Store when the accelerator became stuck, causing the car to run into the back façade of the store. Walker was a passenger in the vehicle. Both women say they suffered multiple injuries as a result of the incident and the vehicle was declared a total loss.

Causes of action filed against the defendant include breach of implied warranty, negligence and products liability.

Taylor and Walker are seeking compensatory damages, declaratory relief, punitive damages, restitution and disgorgement of profits, court costs, attorneys' fees and an order enjoining Toyota from implementing any fixes to the defect without prior approval from NHTSA.

New Orleans attorney Wilson C. Boveland is representing Taylor and Walker

U.S. District Judge Martin L.C. Feldman is assigned to the case.
